Please read these Terms and Conditions carefully prior to participating in Fjällräven AB’s photo contest “Fjällräven Greenland Jacket” (“The Contest”). By participating in the Contest each participant fully and unconditionally agrees to and accepts these Terms and Conditions.
1.1 This Contest is being held by Fjällräven AB ("Fjällräven"), Hemvärnsgatan 15, 171 05 Solna, Sweden. The Contest, which is being staged via the online platforms Facebook and Instagram, is in no way sponsored, supported or organised by Facebook or Instagram. All questions, comments and complaints regarding this Contest should be sent directly to Fjällräven and not to Facebook or Instagram; this also applies to any claims arising from the staging of the Contest. 1.2 All citizens of the world who wants to live outdoorsy and to care about the sustainability are eligible to enter the Contest. Participation will take place exclusively online and is free of charge.
1.3 Participation will take place via the free photo sharing service Instagram or via the social network Facebook. Download the instagram app here.
1.4 The Contest will run from 14:00 p.m. (Swedish time) on October 1, 2014, until 4 p.m. (Swedish time) on October 13, 2014 (”the Contest Period”).
1.5 Make sure that the settings for your instagram posts are not set to private as other participants and likers will not see the image in our feed.
2.1 Any outdoorsy interested who is over the age of 18 at the time of entry, who lives on the planet Earth, and who has a Facebook or Instagram account is eligible to enter the Contest.
2.2 Participation in the Contest is not dependent on a purchase or on the use of services.
2.3 Each participant may enter the Contest with as many photographs as they wish to submit.
3.1 The Contest can be accessed via the photo sharing service Instagram or on the Facebook page listed in 1.3. Users who do not yet have a Facebook, or Instagram account can register free of charge at www.facebook.com or download the free Instagram app for either Iphone or Android users.
3.2 During the Contest Period and in accordance with Fjällräven’s requirements, participants are required to use the free photo sharing service Instagram or the Facebook platform to upload a photo and a recipe that shows the participant's ideal meal in the great outdoors.
3.3. Humans pictured in submitted photos must consent and be over the age of 18 and/or have parental consent. This does not apply to other species.
3.4 All photos submitted via Instagram must be tagged with #greenlandjacket to be eligible for the contest, whilst those uploaded via our Facebook app does not need the tag.
3.5 The following submission content standards and “house rules” shall apply in respect of the content of the photo. Photos must not:
3.6 By submitting a photo, the participant warrant and undertake that they are the legal and beneficial owner of all intellectual property rights in their photo and recipe and that it is their own original work and does not infringe any third party rights. Participants hereby waive and agree not to assert any moral rights in and in connection with the photo.
3.7 All humans pictured in the photo must agree to be featured and for the photo to be submitted via Instagram, Twitter or the Facebook app, and must also waive and agree not to assert any applicable moral or similar rights and agree to the photo being entered in the contest and the entrants warrant that applicable consents have been obtained. These statements also extend to the Facebook and Instagram platforms used.
3.8 By submitting the photo, participants grant Fjällräven and the companies associated with Fjällräven an irrevocable, transferable, worldwide, free right of use covering all methods of use, in particular the use, distribution, reproduction, translation and modification of the photo and any accompanying text for commercial and media purposes by Fjällräven.
3.9 The participant also accept that all photos submitted via Instagram,Twitter or the Facebook will feature in a photo gallery at any of Fjällräven’s social media channels, on marketing material, or on the website of Fjällräven. These pages are updated in real time. This statement also extends to Facebook and Instagram.
3.10 At the end of the contest period two winners will be selected. The jury will review all submitted photos and select the two most most creative and inspirational – from an artistic, photographic and promotional point of view. The most inspiring photograph will receive a prize, which consist of any product from our Greenland Family. The prize cannot be changed into a different prize. The prize also includes shipping fees of the prize to the winner. 3.11 Any taxes, expenses and/or fees associated with the Competition and/or the prize are the sole responsibility of the participants and the winners and will not be covered by Fjällräven.
3.12 The winners will be notified by e-mail or the social media service with which they entered the Contest by Fjällräven within one week of selection. If a winner fails to claim his/her prize within two weeks of the e-mail being sent, any entitlement to the prize shall be forfeited. Participants who have not won will not be notified.
Fjällräven is entitled to identify the winners by name and to feature the winning photo on any Fjällräven website, as well as on Facebook, Instagram or any other social media service. Or other marketing service or material. Each participant expressly accepts this form of publication. Details of prize winners’ names, county and country will be available for at least one month after the close of this Contest by visiting these sites.
3.13 Fjällräven reserves the right to substitute the prizes (or any part of the prizes) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond Fjällräven reasonable control. Under no circumstances will the Fjällräven be paid out in cash. Prizes are non refundable and non-transferable.
Entitlement to the prize may not be reassigned to a third party.
4.1 Employees of Fjällräven and of companies associated with Fjällräven as well as their family members and relatives are excluded from the Contest.
4.2 People who (i) provide incorrect personal details, (ii) provide illegal content, or (iii) manipulate or otherwise misuse electronic devices created for the purpose of the contest are excluded.
4.3 Humans who do not reside on the planet Earth at the time of the contest are also excluded from the Contest. Sorry, astronauts, it would not be fair otherwise.
5.1 Fjällräven is entitled to terminate the contest at any time during the Contest Period, without prior notice and without stating reasons. In particular, this applies in cases where this is necessary for organizational or technical reasons (e.g. computer system viruses, manipulation or errors in the hardware/software) or legal reasons.
6.1 Fjällräven undertakes to observe the Swedish data protection legislation.
6.2 Participants consent to the storage, processing and transmission of their data by the responsible body, Fjällräven AB, as well as the forwarding of the transmitted data to Facebook and Instagram. If expressly prescribed by local law, participants are entitled to contact Fjällräven at the aforementioned address at any time during the contest period to enquire about the storage of their data and notify Fjällräven should they wish to revoke their declaration of consent, thus retiring from the Contest.
6.3 Data shall not be disclosed to third parties for other purposes.
7.1 Fjällräven is only liable for damages caused by Fjällräven or one of its auxiliaries through intent or gross negligence, or through a breach of essential contractual obligations. This limitation does not apply to damages arising from injury to life, limb and/or health.
7.2 The aforementioned liability limitation applies in particular to damages caused by errors, delays or interruptions to the transmission of data, etc., in the event of technical equipment or service faults, incorrect content, loss or deletion of data, viruses or other such causes.
7.3 The participant is obliged to compensate Fjällräven for any damages, claims, costs and legal fees caused by or based on the fact that the participant has uploaded a photo that does not comply with these Terms and Conditions, including uploading a photo that infringes the rights of third parties.
8.1 If Fjällräven has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the contest, choice of prize winner(s) or any entry), Fjällräven reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity.
8.2 Complaints relating to the staging of the Contest must be sent to Fjällräven in writing within 14 days of the complaint arising.
8.3 The decision regarding the selection of prize winners and their results is final and no correspondence will be entered into.
8.4 The Contest is exclusively governed by Swedish law, regardless of the location from which a participant enters the Contest, and the courts of Sweden shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with the Contest. This excludes mandatory consumer protection law at the participant's place of residence.
8.5 Should individual provisions be or become ineffective or unenforceable, the validity of the remaining provisions shall remain unaffected.
